Chief Magistrate Joanne Walsh did not uphold a no case submission filed by one of the defence lawyers in the matter involving three mem to allegedly burglarized a dive shop in English Harbour earlier this year.
Instead, she declared that there is a prima facie case against the trio and therefore committed the matter to the January assizes.
In May 2020, 19-year-old Mauriceson Valentine and 20-year old Dashaungh Richards were jointly charged with breaking and larceny of more than $30,000 worth of equipment from DiveCarib in English Harbour, while 30-year-old Alvin Goodwin was charged with receiving $12,179 worth of the goods.
Goodwin’s council, George Lake sought to prove that there was no case against his client by arguing that Goodwin had no knowledge that the goods were stolen.
Attorney Wendel Robinson who represents both Valentine and Richards, chose not a make a submission.
The Dockyard Drive establishment was burgled on May 8, prompting owners of offer a US $1000 reward for information leading to the retrieval of the goods.
The items stolen include diving tanks, regulators, snorkels, dive computers, compasses, a dive knife and so on.
