Sentencing delayed for man found guilty of causing death by dangerous driving

The sentencing of Kevon Small, who was found guilty of causing death by dangerous driving, has been adjourned to July 11.

In early April, a High Court jury found Small guilty in relation to the 2021 incident that claimed the life of 50-year-old Colin Anderson Joseph.

The verdict was delivered before Justice Ann-Marie Smith after just two hours of deliberation.

The fatal incident occurred on September 1, 2021, at the junction of Market and New Streets.

According to evidence presented during the trial, Small, who was 34 at the time, struck Joseph with his vehicle at the intersection.

Video footage shown during court proceedings captured Joseph walking along Market Street and attempting to cross the road as Small’s vehicle approached from New Street.

When Joseph realized the vehicle wasn’t stopping, he stepped back, but the vehicle continued turning, knocked him down and ran over him before coming to a stop.

Joseph was rushed to Sir Lester Bird Medical Centre with critical injuries, including a fractured skull and trauma to his left leg.

Medical tests showed he had no brain activity, and despite being placed on a ventilator, he eventually succumbed to his injuries.

During the trial, Small made an unsworn statement describing his account of the incident, stating he had slowed down at the junction, checked for traffic, and only felt an impact after turning.

According to police testimony, Small claimed to have a medical condition that allegedly causes chest pain on his left side, leading to dizziness and breathing difficulties.

Small reportedly admitted that stress, anxiety, and exhaustion triggered this condition, but he wasn’t taking medication.

However, there was no evidence presented during the trial to substantiate the existence of this medical condition.

Small, who has remained on bail awaiting sentencing since his conviction, was recently assigned the new court date.

The matter had to be adjourned as some pre-sentencing issues are yet to be completed.
