Montserrat-born Attorney Warren Cassell has been cleared after the Eastern Caribbean Court of Appeal determined his case constituted a miscarriage of justice.
Cassell, who completed his three-and-a-half-year prison sentence in Montserrat in December 2024, was previously convicted in 2022 for concealing proceeds of criminal conduct.
The case involved allegations that Cassell had dishonestly concealed approximately EC$855,380.54 between January 2007 and November 2008 by transferring investor funds into an incorporated account for land sales.
Prosecutors claimed he falsely represented himself as a legitimate director of Providence Estate Limited.
The Court of Appeal ruled that the judge in his case erred when denying a no-case submission.
Given that Cassell has already served his full sentence, the Court concluded no useful purpose would be served by a third trial and therefore cleared him in a court room in Antigua.
